Management Measures for Quality and Safety of Government Grain and Oil Reserves
Chapter 1 General Provisions
Article 1: In order to ensure the quality and safety of government grain and oil reserves, standardize quality management, and in accordance with relevant laws and regulations such as the Food Security Law of the People's Republic of China, the Regulations on the Administration of Grain Circulation, the Regulations on the Management of Central Grain Reserves, and the Measures for the Supervision of Grain Quality and Safety, this method is formulated.
Article 2: These Measures shall apply to the quality and safety management, as well as related supervision and inspection activities, of the government's grain and oil reserves during storage, storage, and outbound processes. The government grain and oil reserves referred to in these measures refer to the central government grain and oil reserves and local government grain and oil reserves, including raw grains such as wheat, rice, corn, soybeans, finished grains, and edible vegetable oil reserves.
Article 3: The administrative department for grain and reserve shall be responsible for the supervision and management of the quality and safety of grain and oil reserves under the leadership of the local government; Guide subordinate grain and reserve administrative departments to carry out quality and safety supervision and management of government grain and oil reserves. The national grain and reserve administrative department is responsible for supervising the quality and safety management of the central government's grain and oil reserves. The vertical management agency of the national grain and reserve administrative department (hereinafter referred to as the Vertical Management Bureau) is responsible for supervising the quality and safety management of central government grain and oil reserves within its jurisdiction. The local grain and reserve administrative department is responsible for the quality and safety supervision and management of grain and oil reserves of the local government at the same level.
Article 4 Enterprises or other organizations that undertake the storage of government grain and oil reserves (hereinafter referred to as storage enterprises), as well as enterprises or organizations that specifically undertake reserve tasks (hereinafter referred to as storage units), shall be primarily responsible for the quality and safety of the stored grain and edible vegetable oil. They shall strictly implement national laws, regulations, rules, policies, and standards, establish and improve quality and safety management systems, clarify the responsibilities and responsible personnel of quality and safety management positions, control quality and safety risks and hidden dangers in key links such as warehousing, storage, and outbound, timely handle quality and safety issues, and ensure that government grain and oil reserves meet quality and safety requirements.
Article 5: Provincial grain and reserve administrative departments shall, in accordance with the relevant provisions of the "Measures for the Supervision of Grain Quality and Safety", establish mandatory quality and safety inspection items for the purchase, storage, and sale of grain.
The government's grain and oil reserve acceptance and sales outbound inspection indicators shall not be less than the required inspection items. The indicators that are not included in the mandatory inspection items should also meet the quality and safety requirements of the government's grain and oil reserves.
The administrative departments for grain and reserve management shall strengthen supervision and inspection in accordance with national laws, regulations, rules, policies, and standards. If it is found that government grain and oil reserves do not meet quality and safety requirements, they shall be investigated and dealt with in accordance with laws and regulations.
Article 6: The transportation of government grain and oil reserves shall comply with relevant standards and technical specifications.
Chapter 2 Quality Management of Warehousing
Article 7: The conventional quality indicators of raw grain reserves shall meet the national standard of medium (or above) quality standards (including water content that meets the requirements for safe storage), the storage quality indicators shall meet the requirements for suitability for storage, and the food safety indicators shall comply with the national food safety standard limit regulations. The source of grain purchased and stored should be new grain produced during the most recent grain production season.
The conventional quality indicators of edible vegetable oil reserves should meet the requirements of relevant national product standards, the storage quality indicators should meet the storage requirements, and the food safety indicators should comply with the limit regulations of national food safety standards. The purchased edible vegetable oil should be a recently processed product.
Article 8: Storage units shall have storage facilities and equipment that can ensure the safety and quality of government grain and oil reserves, and comply with relevant national regulations. Having quality and safety inspection instruments and equipment, inspection sites, and corresponding inspection personnel that are suitable for the storage tasks.
Article 9: Implement a quality and safety inspection system for the purchase and storage of government grain and oil reserves. When purchasing grain, storage units shall conduct quality and safety inspections in accordance with relevant standards and regulations, and the inspection items shall include routine quality indicators and food safety indicators.
Article 10: Implement a government grain and oil reserve quality and safety acceptance inspection system. After the completion of grain storage and filling of edible vegetable oil tanks, acceptance inspection should be carried out, which should include routine quality indicators, storage quality indicators, and food safety indicators. Only those that pass the acceptance inspection can be used as government grain and oil reserves.
Acceptance inspection should follow the principles of objectivity, impartiality, science, and reasonableness, and be entrusted to qualified food quality and safety inspection institutions.
The central government grain and oil reserve storage enterprises shall organize the acceptance inspection of the central government grain and oil reserves in a unified manner, and the results of the acceptance inspection shall be promptly copied to the supervisory authority and the provincial grain and reserve administrative management department for filing; The relevant requirements for the acceptance and inspection of local government grain and oil reserves shall be determined by the same level of grain and reserve administrative management department.
The administrative departments of grain and reserve at all levels shall conduct spot checks on the acceptance and inspection results in accordance with their responsibilities.
Chapter 3 Storage and Outbound Quality Management
Article 11: Storage units shall implement dedicated warehouses (tanks) for government grain and oil reserves, with dedicated personnel for safekeeping, and shall not mix grains or edible vegetable oils with different properties, varieties, production years, grades, and grain rights. It is strictly prohibited to falsely report or conceal the quality and variety of government grain and oil reserves. Strictly follow the requirements for the use and management of chemical agents in grain storage.
Article 12: During the storage period, the storage unit shall strictly implement relevant quality management regulations, regularly conduct routine quality index and storage quality index inspections, and carry out food safety index inspections according to the actual situation.
The government grain and oil reserves shall conduct no less than 2 inspections per storage location every year, and the inspection results shall be uniformly reported to the grain and reserve administrative management department before the end of June and December each year. The inspection results of the central government's grain and oil reserves shall be submitted to the supervisory authority and the national grain and reserve administrative department in accordance with the procedures. The inspection results of local government grain and oil reserves shall be reported to the grain and reserve administrative department of the people's government to which the grain rights belong according to the procedures.
Article 13: For those found unsuitable for storage in government grain and oil reserves, timely arrangements should be made for their release through measures such as rotation. During the storage period, if there are situations such as grain condensation, pest infestation, heating, mold growth, and abnormal odor of edible vegetable oil, the storage unit should immediately take effective measures to dispose of them and minimize losses.
Article 14: Implement a government grain and oil reserve sales and outbound inspection system. The outbound inspection shall be carried out in accordance with the relevant provisions of the Regulations on the Administration of Grain Circulation, and the inspection results shall serve as the basis for outbound quality. Government grain and oil reserves that have not undergone quality and safety inspections shall not be sold or released from storage.
The original or photocopy of the inspection report should be attached to the outbound shipment. The outbound inspection items should include routine quality indicators and food safety indicators. If grain storage agents have been applied during the storage period and the safety interval has not been reached, residual inspection of grain storage agents should also be increased.
Article 15: After grain and edible vegetable oil are stored in warehouses (tanks), quality and safety records for each storage location shall be established in a timely manner in accordance with regulations. Accurately and truthfully record the results of quality and safety inspections and the rectification of relevant issues in chronological order. The original or photocopy of the inspection report and original records shall be fully preserved, and shall not be forged, tampered with, or damaged. The retention period shall be no less than 3 years from the date of sale and delivery of government grain and oil reserves.
The government's grain and oil reserves should strengthen information management, and storage units should implement online dynamic updates of relevant quality information as required.
Article 16: Encourage storage units to proactively understand the quality and safety status of purchased grain sources in advance, and select high-quality reserve grain sources based on market demand on the basis of meeting the government's requirements for grain and oil reserve quality and safety; According to different varieties and qualities, implement refined storage, apply green grain storage or other advanced and applicable technologies; Proactively provide information on processing quality, nutritional quality, taste quality, and storage status when leaving the warehouse.
Article 17: Storage units shall regularly provide training on laws, regulations, rules, policies, standards, and technical specifications for personnel engaged in quality management and inspection, so that relevant personnel can timely grasp the laws, regulations, rules, policy provisions, standards, and inspection techniques of government grain and oil reserve management. Personnel who are unable to fulfill their duties should be adjusted in a timely manner.
The storage unit shall regularly maintain, scrap and update inspection instruments and equipment in accordance with regulations; If it belongs to measuring instruments, it should be verified or calibrated according to the requirements. Quick inspection instruments should undergo quality control tests in accordance with relevant standards and usage requirements.
The administrative departments of grain and reserve should strengthen guidance and services for the quality and safety management of storage units, timely carry out relevant laws, regulations, rules, policies, standards, and technical specifications training, guide and support storage units to strengthen management awareness, improve management systems, and enhance management capabilities.
Chapter 4 Inspection Requirements
Article 18: Grain quality and safety inspection institutions that undertake commissioned inspections of government grain and oil reserves shall obtain qualification certification in accordance with relevant national regulations, be familiar with government grain and oil reserve quality policy requirements, and have a good reputation.
Implement a responsibility system for grain quality and safety inspection institutions and inspectors. The inspector is responsible for the inspection data issued, the reviewer and issuer is responsible for management, and the inspection agency is responsible for the inspection report issued.
Article 19: The entrusted inspection of government grain and oil reserves shall be sampled on site, and shall not be sampled or sent for inspection by the storage unit. The sampling methods, procedures, and personnel shall comply with relevant national regulations or standards. Important nodes in the sampling process should be recorded or photographed to ensure that the sampling process is standardized, fair, and authentic. The sampling organization and sampling personnel are responsible for the compliance of sampling, the authenticity and representativeness of samples, and the accuracy and completeness of information.
The storage unit shall provide true location information, sampling tools, and temporary storage locations for samples, assign auxiliary personnel to cooperate in sampling work, and shall not falsify or exchange samples.
Article 20: During the sampling process, special attention should be paid to whether there are any issues such as grain overheating, mold growth, severe insect infestations, and abnormal odors of edible vegetable oil. There should also be no behaviors such as using stale food, mixing with fake food, passing off inferior products as good, or burying sieved materials. There should also be no fraudulent behaviors such as burying or changing samples.
For the above-mentioned situations, the sampling personnel shall adopt targeted sampling methods in accordance with relevant regulations, conduct separate sampling and evaluation, truthfully record abnormal situations, inform the storage unit to take effective measures in a timely manner, and report to the commissioning party. If it belongs to the central government's grain and oil reserves, it should also be reported to the supervisory authority and the central government's grain and oil reserve storage enterprises. Relevant departments and units should verify the relevant situation.
Article 21: Grain quality and safety inspection institutions shall timely submit the inspection results to the commissioning party in accordance with the report form, submission time, and submission channel required by the commissioning party, and shall assume confidentiality responsibilities for the inspection results.
Grain quality and safety inspection institutions shall properly retain relevant materials such as sampling registration forms and original inspection records, and the retention period shall not be less than 6 years.
Article 22: If the storage unit has objections to the inspection results during supervision and inspection, it shall submit a written application for re inspection within 10 natural days from receiving feedback on the results, and the handling principle shall be implemented in accordance with the relevant provisions of the Measures for the Supervision of Grain Quality and Safety.
Chapter 5 Supervision and Inspection
Article 23: The grain and reserve administrative departments shall, in accordance with their statutory duties, conduct regular or irregular supervision and inspection of the quality management, quality and safety status, and acceptance inspection results of government grain and oil reserves, and impose administrative penalties on illegal and irregular situations in accordance with laws and regulations. The annual inspection results shall be reported to the higher-level grain and reserve administrative department for filing.
The inspection mainly includes the quality and safety status, implementation of the inbound and outbound inspection system, quality management system, etc. According to the actual situation, the annual inspection ratio is generally not less than 30% of the grain and oil reserve scale of the local government within the jurisdiction, and the inspection coverage is not less than 30% of the number of storage units. If no problems are found in the storage points or government grain and oil reserves that have been inspected by the higher-level grain and reserve administrative management department within the year, the lower level grain and reserve administrative management department generally will not repeat the inspection or sampling.
The storage unit shall actively cooperate with the grain and reserve administrative management department to carry out supervision and inspection work, provide various documents, materials, record vouchers required for inspection, arrange necessary auxiliary personnel and corresponding instruments and equipment.
Article 24: In the event of quality and safety accidents (incidents) such as exceeding food safety indicators in government grain and oil reserves, the storage unit shall promptly and properly handle them in accordance with relevant requirements and report to the county-level grain and reserve administrative department where the accident occurred. The central government's grain and oil reserve storage units shall promptly report to the supervisory authority and the provincial grain and reserve administrative department where they are located. Local government grain and oil reserve storage units shall promptly report to the local grain and reserve administrative management department.
If the storage unit has a superior management unit, it shall also report to its superior management unit.
Article 25: Establish a mechanism for rectifying quality and safety issues in government grain and oil reserves. The grain and reserve administrative management department shall promptly notify the storage enterprises and propose rectification requirements for situations such as substandard quality, unsuitable storage quality, and excessive food safety indicators found during inspections.
Storage enterprises shall promptly notify storage units, supervise and guide their affiliated storage units to formulate rectification plans, clarify rectification measures, time limits, responsible persons, and track and supervise the rectification work.
Article 26: Storage units shall strictly comply with laws, regulations, rules, policy provisions and standards, as well as the requirements of grain and reserve administrative management departments, and take effective measures to rectify in a timely manner.
For grains that do not meet quality standards such as impurities, incomplete grain content, and moisture content that do not meet safety storage requirements, timely measures such as cleaning, sorting, and drying should be taken to strengthen grain monitoring, pay attention to ventilation, and ensure storage safety and quality safety; For grains and edible vegetable oils that are not suitable for storage quality, measures such as rotation should be taken to dispose of them properly in accordance with relevant regulations; For grains and edible vegetable oils that do not meet national standards in terms of food safety indicators, they shall be disposed of in accordance with the principles of harmless treatment and rational utilization of resources, and relevant national and local regulations. It is strictly prohibited for grains and edible vegetable oils that do not meet food safety standards to enter the grain market and food production enterprises.
The rectification situation shall be submitted to the administrative department of grain and reserve on time.
Article 27: If the storage unit engages in fraudulent activities such as using Chen Dingxin, mixing with fake materials, passing off inferior materials as good, burying screened materials, burying or replacing samples, or discovering violations of laws and regulations during supervision and inspection and failing to rectify them in a timely manner as required, the grain and reserve administrative management department shall, based on the verification results and management authority, handle the storage unit and relevant responsible personnel in accordance with regulations, discipline and law.
If the grain quality and safety inspection institutions and personnel responsible for entrusted inspection violate relevant regulations by issuing false or misleading inspection reports, they shall be dealt with in accordance with relevant laws and regulations, and included in the national credit information sharing platform in accordance with the relevant provisions of the Measures for the Supervision of Grain Quality and Safety.
Article 28: Any organization or individual has the right to report any quality, safety, disciplinary, or illegal activities in government grain and oil reserve activities through channels such as the 12325 Grain and Material Reserve Supervision Hotline.
Chapter 6 Supplementary Provisions
Article 29: If the state has other regulations on the quality and safety management of government grain and oil reserves, those regulations shall prevail. The quality and safety management requirements for finished grain and small packaged edible vegetable oil reserves shall be formulated by the provincial grain and reserve administrative management department.
Article 30: These Measures shall be interpreted by the State Administration of Grain and Material Reserves.
Article 31: These measures shall come into effect from the date of issuance and shall be valid for 5 years.
